Summary of the General Mobilization Law Presentation
On Monday afternoon, at the People’s National Assembly (APN), Minister of Justice Lotfi Boudjemaa presented a significant bill concerning general mobilization. The presentation occurred during a plenary session chaired by APN President Brahim Boughali, alongside Minister of Relations with Parliament Kaouter Krikou.
Boudjemaa emphasized that this legislative initiative aims to enrich Algeria’s legal framework and enable the country to effectively address potential dangers, especially in the current volatile geopolitical climate. The bill outlines the roles and responsibilities of various state institutions, public and private sectors, civil society, and citizens within a comprehensive system of general mobilization to safeguard national stability.
Comprising 69 articles, the law defines the provisions associated with general mobilization as stipulated in Article 99 of the Constitution. It details the necessary actions for transitioning state forces, institutions, and the economy from a peacetime state to a wartime readiness, thus mobilizing national competencies for defense efforts.
The primary goal of this mobilization is to enhance national defense capabilities and bolster the armed forces with adequate human and material resources. This initiative is designed to ensure the protection of Algeria’s territorial integrity and sovereignty across land, air, and maritime domains.
The legislation specifies scenarios wherein the President may declare a state of general mobilization, particularly in situations of imminent threats to constitutional institutions, national independence, or territorial integrity, as well as during actual or impending aggression, conforming to constitutional guidelines.
It stipulates that the President shall outline the fundamental aspects of the mobilization strategy through a presidential decree. The Prime Minister will oversee coordination and control of government activities to implement this strategy efficiently.
Implementing general mobilization involves transitioning the armed forces from a state of peace to one of war, executing necessary actions by relevant ministries, applying provisions regarding popular defense according to current legislation, and instituting measures like requisitioning resources. Furthermore, it encompasses the temporary suspension of retirements for officials and workers in critical roles related to the mobilization.
Additionally, the Minister of National Defense is charged with gradually activating the general mobilization plan, coordinating with concerned ministers. This involves supporting armed forces’ operations, optimizing resources like energy and water, and enhancing the protection of vital institutions.
Citizens are also required to adhere to mobilization procedures, responding promptly to recalls and measures implemented by authorities. Non-compliance could lead to penalties, with the proposed law detailing imprisonment terms ranging from two months to a decade, alongside fines between 20,000 and one million DZD for individuals or entities violating any regulations.
This legislative proposal reflects Algeria’s commitment to preparedness and resilience in the face of potential national threats, aiming to foster a cohesive response across various sectors of society, thereby ensuring the country’s stability and security.
